Texas Legislatures, Prosecutors, and Police officers are on a witch hunt for DWI drivers. As far as priorities in law enforcement goes, DWI is in the top 3 with sexual assault of a child and murder. They are removing your constitutional rights any way they can just to get a few more DWI notches in their belts.
Some people might think this is a good thing. More DWI arrests mean more DWI drivers off the road. What they forget about is that a witch hunt causes a lot of innocent people to get pulled into the system. People with family and jobs. Someone who stops in for an after work beer and now must live with a Scarlett A on his chest forever. These arrests and subsequent prosecution can cost an ordinary man his job, his car, and several thousand dollars.
Texas wants you to suffer even if you are exonerated and found not guilty. They will take your license away, they will forcibly take your blood, they will subject you to ridicule. Texas has taken away nearly all options for plea bargaining and have limited your constitutional rights in court. They embarrass you with a breathalyzer in your car, even before you are convicted.

Hire an attorney who will take the officer's story to task. Hire an attorney who will examine and dissect the unreliable data that is produced from the breathalyzer or the blood analysis. You need someone who will fight for ever inch.
There are many stages of the game which you may not even know about. When they try to take your license away, did you know you can fight for it back? Texas doesn't give you much of a chance, since they close the window only 15 days after the arrest. But you can request and ALR hearing and perhaps save your license and produce good testimony that you can use later. |
